How to prepare an application for a certificate of appointment of estate trustee with a will?

First and foremost, the application must be filed with the court of appropriate jurisdiction where the estate is located. If the deceased’s will names an executor, then the application must be filed with the court in the county where the will is probated.

Although the application is fairly simple, some of the information you need to provide can be difficult to track down, including the deceased’s will, the original death certificate, and the original Certificate of Appointment of Estate Trustee.

For a will to be valid, the will must be signed by the testator. The testator is the person making the will. Then the will must be signed by at least two witnesses who must be present at the will signing. The will can be signed anywhere, but in the presence of the testator and at least two witnesses.

The first step is to complete and submit Form T1, Request for a Certificate of Appointment of Estate Trustee with a Will. This step will be completed with your lawyer, if you have one, or with a paralegal or notary public.

To apply for the certificate of appointment of estate trustee with a will, you will need to file Form T7C, Application for Certificate of Appointment of Estate Trustee with a Will. If you are applying for a certificate of appointment as sole estate trustee, you must also complete Part 2 of Form T7C.
